What changed: According to the notice, Presidential Proclamation 10984 (Oct. 17, 2025) authorized Commerce to approve certain USMCA-qualifying MHDV imports to apply the 25 percent Section 232 tariff exclusively to the non-U.S. content. The notice states that Commerce issued submission procedures on Feb. 2, 2026 (91 FR 4504) for importers to determine U.S. content, and it provides CBP entry-filing instructions referencing HTSUS heading 9903.74.03.

Who's affected: The notice names medium- and heavy-duty vehicles (MHDVs) qualifying for preferential treatment under USMCA, and cites Canada and Mexico as affected origins. It references HTSUS heading 9903.74.03.

What to review:
- Review whether your MHDV imports have received approval from the Secretary of Commerce under the referenced procedures before applying the non-U.S. content treatment.
- Confirm with your broker how HTSUS heading 9903.74.03 and the 25 percent duty on non-U.S. content may be reported on entries.
- Check the Commerce submission procedures at 91 FR 4504 for how U.S. content is documented.
- Review whether your goods may qualify for USMCA preferential treatment as described in Proclamation 10984 (90 FR 48451).
