📌 ETDETA brief — importer impact summary (educational)

Brief takeaway: The ITC has opened preliminary antidumping and countervailing duty investigations into glyphosate from China, which could eventually lead to new duties on those imports.

What changed: According to the notice, the Commission instituted preliminary phase AD/CVD investigations (Nos. 701-TA-799 and 731-TA-1795) to assess whether U.S. industry is materially injured by imports of glyphosate from China alleged to be sold at less than fair value and subsidized by the Chinese government. The notice states the Commission must reach a preliminary determination within 45 days, by August 14, 2026, with views transmitted to Commerce by August 21, 2026.

Who's affected: The notice names glyphosate from China, provided for in HTS subheadings 2931.49.00 and 3808.93.50. The cited country of origin is China (CN).

What to review:
- Review whether your imported products may fall within the glyphosate scope described and the HTS subheadings 2931.49.00 or 3808.93.50 cited in the notice.
- Confirm the country of origin of your glyphosate imports with your customs broker.
- Check the timeline for the preliminary determination and any later Commerce actions that may affect future entries.
- Confirm with a licensed customs broker or trade counsel whether any deposit, reporting, or scope considerations may become relevant to your entries.
