Certain Beverage Brewing Products and Components Thereof; Notice of Institution of Investigation

📌 ETDETA brief — importer impact summary (educational)

Brief takeaway: The ITC has opened a Section 337 investigation into certain beverage brewing products and their components based on patent-infringement allegations, which could eventually lead to import restrictions on infringing goods.

What changed: According to the notice, a complaint (amended February 3, 2026) was filed on behalf of Adrian Rivera Maynez Enterprises, Inc. alleging that the importation, sale for importation, and post-importation sale of certain beverage brewing products and components infringe claims of three U.S. patents. The notice states the complainant requests a limited exclusion order and a cease and desist order, and that the Commission institute an investigation.

Who's affected: The notice names "certain beverage brewing products and components thereof" as the subject articles. It cites U.S. Patent Nos. 12,396,588, 11,737,597, and 10,865,039 as the asserted patents. The notice does not specify HTS codes or countries of origin.

What to review:
- Review whether your imported beverage brewing products or components may fall within the described category.
- Check the asserted patents with counsel to assess whether they may be relevant to your products.
- Confirm with your customs broker or trade counsel how a potential limited exclusion order or cease and desist order could affect your shipments.
- Review the ITC docket for the named respondents and investigation scope as it develops.
