Certain Dental Burs and Kits Thereof; Notice of Institution of Investigation

📌 ETDETA brief — importer impact summary (educational)

Brief takeaway: The ITC has opened a Section 337 investigation into whether certain imported dental burs and kits infringe specific U.S. patents and trademarks, which could eventually lead to import exclusion or cease-and-desist orders.

What changed: According to the notice, the ITC instituted an investigation based on a complaint (amended January 6, 2026) filed by Huwais IP Holding LLC and Versah, LLC. The notice states the complaint alleges that importation, sale for importation, and sale within the United States after importation of these products infringes the identified intellectual property. The notice adds that the complainants request a general exclusion order, or alternatively a limited exclusion order, plus cease-and-desist orders.

Who's affected: The notice names certain dental burs and kits thereof. It cites U.S. Patent Nos. 9,326,778 and 11,712,250, and U.S. Trademark Registration Nos. 6,261,888, 6,261,886, and 4,689,471. No specific HTS codes or countries of origin are named in the notice.

What to review:
- Review whether your imported products fall within the described category of dental burs and kits.
- Check the cited patents and trademark registrations against your products and their branding.
- Confirm with your broker or counsel whether a general exclusion order could reach your goods regardless of manufacturer.
- Review the docket for the investigation's scope, respondents, and any future exclusion or cease-and-desist orders.
