These Terms of Use ("Terms") govern your access to and use of etdeta.net (the "Site") and the free import tools it offers, operated by ETDETA Logistics Inc. ("ETDETA", "we", "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. The service
The Site provides free, AI-assisted informational tools for U.S. importers, including HTS classification suggestions, an import duty and landed-cost calculator, trade-compliance briefs, and import data. The tools are provided for general information and planning only. They do not constitute legal, customs, tax, or financial advice, and do not create any broker-client or attorney-client relationship. See our Disclaimer.
2. Eligibility and accounts
- The Site is intended for business use by people who are at least 16 years old. If you use it for a company, you represent that you are authorized to do so on its behalf.
- If you register, you must provide an accurate email address and are responsible for activity under your account. Free usage is subject to daily limits, which we may change at any time.
3. Acceptable use
You agree not to:
- scrape, crawl, harvest, or perform bulk extraction or data mining of the Site, its data, or its results;
- access the Site through automated means, or make excessive or abusive requests beyond the usage limits we provide;
- circumvent or attempt to circumvent rate limits, registration requirements, quotas, or security measures, or probe or reverse-engineer the Site;
- resell, redistribute, or commercially exploit the tools, data, or results except as expressly permitted;
- upload content you do not have the right to share, or any material that is unlawful, infringing, confidential to others, or contains malware;
- use the Site for any unlawful purpose or in violation of these Terms or applicable export, sanctions, or customs laws.
4. Your content and uploads
You retain ownership of the descriptions, codes, and files you submit ("Your Content"). You grant ETDETA a limited, worldwide, royalty-free license to host, process, and transmit Your Content (including to our AI subprocessors) solely to provide and improve the tools. You represent that you have the rights to submit Your Content and that doing so does not violate any law or third-party right.
5. Intellectual property
The Site, its software, design, text, and our compilations and presentation of data are owned by ETDETA or its licensors and are protected by law. Underlying tariff and trade data is sourced from public government records (e.g., USITC, CBP, the Federal Register, and the U.S. Census Bureau); while that raw data is public, our selection, arrangement, and presentation are protected. Subject to these Terms, we grant you a limited, revocable, non-exclusive license to use the tools for your own internal business purposes.
6. No professional advice; accuracy
Results are AI-generated estimates based on available data and may be inaccurate, incomplete, or out of date. Tariff rates and trade policies (including Section 301/232, IEEPA, and antidumping / countervailing measures) change frequently. Only U.S. Customs and Border Protection can issue binding tariff classification rulings. You are responsible for the codes you declare and the decisions you make, and should confirm them with a licensed customs broker and CBP.
7. Freight quotes
A request for a freight quote is an inquiry only and does not create a binding offer or contract. Any freight, customs-brokerage, or logistics services are governed by a separate written agreement and by ETDETA Logistics Inc.'s applicable tariff and terms.
8. Third-party services
The tools rely on third-party providers (including AI providers and data sources). Their processing is subject to their own terms, and we are not responsible for third-party services or content.
9. Disclaimer of warranties
THE SITE AND ALL TOOLS, RESULTS, AND DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL BE ACCURATE OR CURRENT.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETDETA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, DUTIES, PENALTIES, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY RESULTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US FOR THE SITE (WHICH IS ZERO FOR THE FREE TOOLS), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.
11. Indemnification
You agree to indemnify and hold ETDETA harmless from any claims, losses, and expenses (including reasonable legal fees) arising from your use of the Site, Your Content, or your violation of these Terms or applicable law.
12. Suspension and termination
We may suspend or terminate your access at any time, with or without notice, if you violate these Terms or misuse the Site, or to protect the Site and other users.
13. Governing law
These Terms are governed by the laws of the United States and the state in which ETDETA Logistics Inc. is organized, without regard to conflict-of-laws rules. You agree to first try to resolve any dispute informally by contacting us. The exclusive venue for disputes will be the state or federal courts located in that state.
14. Changes to these Terms
We may update these Terms from time to time. Changes are effective when posted with a new "Last updated" date. Your continued use of the Site constitutes acceptance.
15. Miscellaneous
If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a business transfer. These Terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and ETDETA regarding the Site.
